By accessing or using the website operated at www.ithrivein.com and such other locations as made available from time to time (collectively, the “Website”) and the services offered through the Website, you (“you” and, together with all persons accessing or using the Website, collectively, the “Users”) signify that you have read, understand, and agree to be bound by these Terms and Conditions (the “Terms and Conditions”) with ThriveTribe Wellness Solutions Pvt. Ltd. (“us”, “we” or “our”), in all respects concerning the Website.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THESE INCLUDE BUT ARE NOT LIMITED TO, VARIOUS LIMITATIONS AND EXCLUSIONS, AND INDEMNITIES.
Your use of the Website is subject to these Terms and Conditions. If you are not willing to be bound by every term or condition, or if any representation made herein by you is not true, you may not use, and must cease using, the Website.
iThrive's ALIVE PROGRAM CONSENT TERMS
You acknowledge that the nature and purpose of the iThrive treatment protocol have been explained to you whenever necessary and you have been allowed to ask questions.
You understand that a change of medical condition or medications can affect the protocol or treatment outlined by iThrive. You recognize the importance of notifying iThrive of any changes in your health and you agree to do so immediately.
You understand that iThrive does not handle acute health conditions and you will need a Primary Care Physician / Family doctor to attend to any of your medical emergencies while you are on iThrive protocol.
You understand the key to healing is your commitment to comply with prescribed dietary changes, supplements, medications, and other treatment recommendations. If you don’t follow the plan with reasonable consistency, your progress will likely be stalled. (Please refer to iThrive terms of engagement for more information on how you can get in the way of your own healing). In such an event, you agree and confirm that iThrive may discontinue your treatment and may ask you to unsubscribe from the program. In such an event, you shall not be negligible for any refund.
You agree and give consent to iThrive to access and share your details mentioned in the form including personal details and medical records, with the team involved in your care and treatment. You agree and give consent for this data to be used for research and publication purposes.
You understand functional nutrition is a different approach from the existing healthcare model. You understand the iThrive team must identify difficulties you might be having with behaviors that are interfering with your stated goals and recommend additional services. You consent to receive recommendations for additional services that include a range of behavioral and meditation therapies.
You hereby release and discharge iThrive from any potential claim, loss, damage, etc. (“Loss”) that you may suffer or have against iThrive, as a result of, or occurring out of, or due to any treatment recommended by iThrive under their program in the event you suffer such Loss due to – (i) your non-adherence to the instructions and guidelines recommended by Thrive, or (ii) concealment, whether complete or partial, of any medical condition, history, treatment, or allergy(ies) that you may have or are suffering with.
iThrive shall not be liable to you for any incidental, indirect, consequential, or special damages.
All claims/disputes shall be subject to the exclusive jurisdiction of courts at Pune and this choice of location will be determined at iThrive’s sole discretion.
Recurring E-Mandate Policy
The term “e-mandate” shall mean consent given by a customer at a merchant platform (website/mobile application) to debit their payment method for recurring payment requests received from the merchant.
The term “Merchant” shall mean a company, organization, or entity that sends a bill, statement, invoice, or a request for payment for a product or service to the customer, based on the customer giving consent for a recurring mandate or payment instruction.
The term “Merchant Platform” refers to the website, web application, or mobile application of the merchant.
The recurring e-mandate can be given to merchants that are compliant with the relevant guidelines and regulations on the processing of e-mandates for recurring transactions.
The recurring e-mandate service will be available to customers who have registered for any of the Alive Programs only.
Once a recurring e-mandate is set up on a Merchant Platform, payment debits shall be done as and when a payment authorization request is received from the Merchant.
It shall be the responsibility of the Merchant to ensure correct bill details are passed on. iThrive will not be liable for any failed payments on account of incorrect/incomplete bill details shared by the Merchant.
Customers should keep track of any SMS or email alert/s pertaining to e-mandates set at Merchants. iThrive will not bear the responsibility or consequence of late payments if the authorization requests are received late from the Merchant.
The customer cannot cancel the E-Mandate or Autopay without the prior consent of the Merchant, if canceled by the customer without prior consent, then charges would be deducted based on the total payment.
iThrive reserves the right to revoke and/or discontinue the recurring mandate service if there is reason to believe that continuing this service shall prejudice the commercial situation of iThrive.
